Does replacing carpet with laminate need a permit in Santa Clara?
The Building Division's bulletin library has no handout listing permit-free finish work. Its Building Division says a permit is required before a building is altered, repaired or improved, and its remodel handout ties a permit to lower cabinets coming out or more than 32 square feet of wall or ceiling finish being replaced. A floor laid around cabinets that stay is not on that list. Ask the Permit Center before work starts, and plan on a permit for any joist or subfloor repair.
Can our contractor bring their own dumpster to a Santa Clara job?
Not in a residential zone. Public Works says Mission Trail Waste Systems is the only company permitted to place and collect debris boxes in the city outside areas zoned industrial, and that using a non-franchised hauler for a box violates the municipal code. The construction waste rules add that a box set on a City street needs an encroachment permit first. A contractor carting debris away in a truck is a different arrangement from renting a box.
Our Old Quad house is on the Historic Resources Inventory. Does refinishing the floors need historic review?
Generally not. The Planning Division's summary puts interior like-for-like work, floors named among the examples, with dry rot repair and painting, and lists no historic permit for it. Two limits apply. A small project stops being small if it removes protected interior features without a like-for-like replacement, and gutting the interior to the studs while reconfiguring the floor plan and changing windows and doors takes a Major Significant Property Alteration permit.
Will the city's pickup take carpet we pull out of a rental?
For single-family homes and townhomes, Mission Trail's on-call bulky item collection removes up to three bulky items and two one-cubic-yard debris bags from the curb, for a fee, though not every HOA participates. The city's annual Cleanup Campaign takes carpet set out by residents but refuses contractor-generated construction debris. For recycling, CARE lists drop-off sites in San Jose and the SMaRT Station in Sunnyvale.
Our 12-unit building has 1970s sheet vinyl. Is a sample enough before it comes up?
No. The Air District's lighter path, a sample and lab test without a full survey, applies only to residential buildings with four or fewer units. A 12-unit building needs an asbestos survey of the affected area before the renovation, by a person certified by Cal/OSHA who has passed an EPA building inspector course. If the vinyl tests positive, removing 100 square feet or more is work for a contractor registered with Cal/OSHA.
