Santa Clara for pros: per-head tax, Simple Permits and the Old Quad

Santa Clara taxes a business by head count, owner included, and a contractor based elsewhere pays a share of the per-employee rate set by how many days a year he works in the city. Renters fill almost six in ten occupied homes and 29.3 percent of units sit in buildings of 20 or more, so apartment and condo calls outnumber house calls, and the city's fast Simple Permits leave condos and townhomes out.

Working legally here

Santa Clara's business tax: head count and days in town

Every business operating in Santa Clara files a New Business Tax Affidavit and pays an annual Business License Tax, online at business.santaclaraca.gov, by mail or at the Business Tax Unit in City Hall on Warburton Avenue. The tax is charged per employee, and the city counts owners, officers, partners and part-time or temporary workers. A contractor based outside the city reports the people who will work in Santa Clara and the days they will work there in the coming year: 6 to 64 days pays a quarter of the rate, 65 to 129 days half, 130 days or more all of it. Reporting zero employees is not accepted. A business run from a Santa Clara address also needs a Zoning Clearance, and approval of a new license can take up to eight weeks.

Permits

Simple Permits, the regular permit list and listed houses

  • Building Simple Permits

Santa Clara's Building Simple Permits cover limited like-for-like work on single-family houses, duplexes and ADUs: water heater replacement, re-roofs without structural work, furnace, air conditioner and duct swaps, re-piping and sewer or water service lines. You apply through the Permitting Online Portal, where an automatic check issues many on the spot and flagged ones follow in one to two business days, and the fee is not refunded. Townhomes, condos, apartment complexes and properties in historic areas or with open code cases do not qualify.

  • What needs a regular permit

The Building Division requires a permit for decks over 30 inches high, sheds over 120 square feet, fences over 7 feet and retaining walls over 4 feet measured from the bottom of the footing. Even on a small shed, new circuits or receptacles need a permit for the electrical work, and the residential checklist adds window size changes, new windows and re-roofing. Applications received from January 1, 2026 are checked against the 2025 California codes, and every file is submitted electronically.

  • Houses on the Historic Resources Inventory

Renovating a house on Santa Clara's Historic Resources Inventory takes a Significant Property Alteration permit. Minor SPAs, for work with little visual change, are handled by staff without a hearing; major ones go to the Historical and Landmarks Commission, and the city says removing or damaging key features such as original windows means the job is no longer minor. A project within 200 feet of a listed property needs no SPA, though one sent to a Development Review Hearing is also reviewed by the commission.

The homes

51,886 homes, with more renters than owners

Santa Clara has 51,886 housing units in the ACS 2019-2023 estimates, and half of them were standing by 1973. Owners occupy 41.2 percent of occupied homes, so renters are the majority. Detached houses are 37.2 percent of units and buildings with 20 or more units 29.3 percent. The 1950s built 21.0 percent of the stock, more than any other decade, and 2010 to 2019 added 11.6 percent. The work splits along those lines: post-war houses on one side, and on the other, apartment and condo units where a landlord or association hires the pro and sets the rules, and where the quick Simple Permits do not apply.

Part by part

Three Santa Clara districts and how a job there runs

  • Old Quad

The General Plan's historic inventory places a number of the city's listed resources in the Old Quad and Agnew neighborhoods. Because projects in historic areas are shut out of Simple Permits, even a like-for-like water heater or re-roof here goes through a regular permit, and window or trim work on a listed house can need an SPA.

  • Rivermark

Rivermark was built under the Rivermark-Agnews West Campus Master Community Plan, with planned-development zoning and its own design guidelines and development standards, so read those before exterior work. Its condos and townhomes fall outside Simple Permits, so a water heater swap there means a regular permit, and part of Rivermark Plaza is on the city's permit-parking list.

  • Tasman East

A 45-acre industrial neighborhood bounded by Tasman Drive, the Guadalupe River, the city golf course and Lafayette Street, which the 2018 specific plan opened to high-density housing at up to 100 units an acre. Approved projects line Calle De Luna and Calle Del Mundo, so the work is in new buildings: assembly, mounting and turnover touch-ups for a property manager.

Getting around

Expressways, permit streets and the 300-foot rule

The city's pedestrian plan names the Caltrain tracks, Highway 101 and Central Expressway as east-west barriers with few crossings, so allow time between the homes south of the tracks and the north side. More than 50 street segments, The Alameda and Rivermark Plaza among them, carry posted limits for anyone without a resident or visitor permit, so ask the client for a visitor pass. Within 300 feet of residentially zoned property, City Code 9.10.230 confines construction and material deliveries to weekdays between 7 a.m. and 6 p.m. and Saturdays between 9 a.m. and 6 p.m., with holidays off.

Questions

Working in Santa Clara: what pros ask

I work out of San Jose. How is my Santa Clara business tax figured?

You file the same application as an in-town business, listing the people who will work in Santa Clara, owner included, and the number of days you expect to work there in the next year. The tax is that head count times 25 percent of the per-employee rate for 6 to 64 days, 50 percent for 65 to 129 days, or the full rate for 130 days or more. You do not need the Zoning Clearance that in-town businesses file.

Can a condo water heater in Santa Clara go through Simple Permits?

No. Simple Permits are limited to single-family houses, duplexes and ADUs, and the city lists townhomes, apartment complexes and condos as not eligible. A condo water heater goes in as a Building Regular Permit through the Permitting Online Portal, with its own review time. On a house, a like-for-like water heater replacement is one of the Simple Permit types and can be issued instantly.

Does a 6-foot fence or a low deck need a Santa Clara building permit?

Not on the building side, going by the city's list: fences need a permit over 7 feet, decks over 30 inches high, sheds over 120 square feet and retaining walls over 4 feet measured from the bottom of the footing. Any new electrical circuit or receptacle needs a permit for the electrical work whatever the size of the structure, and a re-roof or new window needs one too.

What hours can I work next to homes in Santa Clara?

Inside 300 feet of residentially zoned land, City Code 9.10.230 gives you non-holiday weekdays until 6 in the evening, starting at 7, and non-holiday Saturdays from 9 until 6, and the limit covers deliveries of materials too. Sunday is not among the permitted days, the holidays the section lists are off, and the police department takes complaints.

Will I know a job is in Santa Clara before I pay for it?

Yes. A hot-list text arrives when a job goes on sale and states its trade and area up front. Tap through and the job description and the lead price appear before any payment, so you can buy or ignore it. You are charged only for handyman jobs in Santa Clara or elsewhere that you choose, never a fee to stay listed, a bid or a commission, and texting STOP takes you off.

The next job in Santa Clara could be yours.
