Home remodeling Milpitas

Moving the sink, the range or a wall in a Milpitas kitchen

Milpitas treats remodeling a kitchen as building permit work, and one combination permit can carry its building, electrical, plumbing and mechanical parts. Once the layout moves, the city's own handouts follow it: wall cabinets stay 30 inches above a cooktop unless shielded, a new gas range brings an automatic shut-off device, and smoke alarms keep their distance from the stove. Near the creeks, the remodel's cost counts toward a 49 percent flood-zone test the city tracks for ten years.

The work

What a Milpitas kitchen takes on as the layout moves

  • A sink moved to a new island

Before anyone saw-cuts or breaks a slab floor to run a drain out to an island, the city's kitchen handout says to find out whether it is a post-tension slab, because cutting a tendon is dangerous and costly to repair. The island counter then gets a receptacle on or above it, or a provision for adding one later. The dishwasher discharges through an air gap fitting, and its cord, 3 to 6.5 feet long, plugs into a GFCI-protected outlet in the space beside it.

  • A gas range in a new spot

Milpitas Municipal Code II-170-2.00 calls for an excess flow shut-off device at the outlet of any new or replacement gas appliance, and once the fuel line itself is altered, a seismic or excess flow device downstream of the meter. The installer has to confirm the gas supply is sized for the new range, keep any flexible connector in the same room as the appliance, and duct the hood outdoors through a backdraft damper, ending at least 3 feet from a property line or opening and 10 feet from a forced-air inlet.

  • Wall cabinets over the cooktop

The kitchen handout keeps combustible material and metal cabinets at least 30 inches above a cooking top. That can drop to 24 inches in three ways: lining the cabinet's underside with quarter-inch insulating millboard covered in sheet metal, centering a metal hood at least as wide as the appliance beneath it with a quarter-inch gap, or installing a listed microwave or cooking appliance over a listed range according to its instructions.

  • Induction, and the circuits behind it

A range rated 8 3/4 kilowatts or more needs a branch circuit of at least 40 amps, and a cooktop whose maximum demand passes 60 amps has to be split into two or more circuits protected at no more than 50 amps each. When circuits or loads are added, Milpitas wants the panel load calculated and the panel or a sub-panel upgraded where needed. The city's Go Electric, Milpitas! program adds its own induction rebate through Silicon Valley Clean Energy.

  • Opening the wall to the family room

A plan that cuts into a load-bearing or shear wall cannot use the city's express counter review and joins the standard plan review queue. Whatever shape it takes, the finished kitchen needs at least 70 square feet of floor and a ceiling no lower than 7 feet. Where the kitchen opens to the garage, the door between them must be 1 3/8-inch solid or honeycomb-core steel or rated for 20 minutes, self-latching, and closed by a self-closing or automatic device.

The houses here

Mostly sixties-to-nineties houses, and most of them owner-occupied

The city's 2023-2031 Housing Element counts 24,638 homes. The largest share, 36.4 percent, went up between 1960 and 1979, another 30.2 percent between 1980 and 1999, and fewer than 8 percent are older than that. Detached houses account for 12,228 of them, and more than 85 percent of those are owner-occupied. City staff estimate that 8 percent of the housing stock needs rehabilitation. Age shows up at the final inspection: the kitchen handout makes replacing non-compliant plumbing fixtures in a one- or two-family house a condition of approving any permit, under Civil Code section 1101, so a new kitchen can bring new toilets and showerheads with it.

Free to request, and you agree the scope and price with the person you hire before work starts. In California, a job over $1,000 in labor and materials, or one that needs a building permit, must be done by a contractor licensed by the CSLB in the right class. Ask for the license number and check it at cslb.ca.gov.

Permits and local rules

Milpitas papers a kitchen remodel is checked against

  • Kitchen Remodel (Residential) handout

Dated January 1, 2026, the handout says the permit goes only to the owner or an authorized agent, and a contractor acting as agent must hold the proper license classification. If an owner doing the work fails an inspection that shows it cannot be completed satisfactorily, a licensed contractor must finish it, and an owner who hires workers needs workers' compensation coverage before inspection. Keep the plumbing fixture boxes for the inspector. Rough framing, mechanical, electrical and plumbing are usually inspected together, insulation before the walls close, and drywall fastening before tape.

  • Smoke alarm, carbon monoxide alarm and spark arrester certificate

Alarms must be in place before the final in houses, townhomes and condominiums. A smoke alarm sits at least 20 feet from a permanently installed cooking appliance, or 10 feet for a photoelectric unit or an ionization unit with a silencing switch, and a photoelectric alarm may go more than 6 feet away in an open plan where 10 feet would leave no legal spot. Alarms must be hard-wired and interconnected when the work exposes the structure or an attic or crawl space gives access for the wiring.

  • Substantial improvement in the flood zone

In the Special Flood Hazard Area, any improvement costing 49 percent or more of the structure's market value before work starts is a substantial improvement, and the house must then meet the floodplain rules for new buildings. Improvements are added up over 10 years. The city asks for a professional appraisal less than three months old, a signed declaration form and a site plan, and it uses the higher of its own building valuation data or the contractor's estimate.

  • Construction and demolition debris

Milpitas Sanitation, Inc. is the franchise hauler for all discarded material, construction debris included. The only alternative is self-hauling by the property's owner, occupant or resident in their own vehicle, and self-haulers must separate organic waste such as untreated wood and cardboard under SB 1383. For houses, the CALGreen recycling report and 65 percent diversion apply to new buildings and to additions or alterations that increase conditioned space, so a kitchen that stays inside its walls does not trigger them.

Part by part

Parts of Milpitas where a kitchen permit takes another path

  • Along Calera, Penitencia, Berryessa, Los Coches and Tularcitos creeks

The Special Flood Hazard Area, about a quarter of the city, lies near these creeks. A remodel here cannot use express counter review, and its cost counts toward the 49 percent substantial improvement test. Land Development can say whether the city already has an elevation certificate on file for the house.

  • West of Interstate 880

A majority of this area was taken out of the flood zone in 1997, after the Coyote Creek improvements were completed, so many kitchen remodels here never meet the substantial improvement test. Check the current FEMA map for the parcel rather than assuming.

  • The eastern hillsides

The city's express plan review criteria for residential remodels state that they do not apply to hillside properties, so a hillside kitchen plan goes through standard review even when it is small.

  • Milpitas Metro, around the Great Mall and BART

The design guidelines for this transit area plan townhouses and rowhouses among its new housing. Where a kitchen in one shares a wall with a neighbor, express review is closed to work that alters fire-resistive construction, and the city's online permit types cover single-family homes and duplexes only, not multifamily buildings.

Timing

Review clocks and working hours in Milpitas

The Office of Building Safety estimates 3 to 5 business days to accept a submittal and 15 to 30 business days for the first plan review; a corrected set takes another 3 to 5 days of intake and 12 to 25 days of review, and the clock starts only once every fee is paid. Express counter review runs first come, first served, mornings and afternoons, with Thursday mornings starting at 10. Construction may run 7 a.m. to 7 p.m. every day under MMC V-213-3(c), but not on city holidays.

Before you hire

Ask before a Milpitas kitchen comes apart

  • Does the plan open any load-bearing or shear wall? That alone takes a Milpitas kitchen out of express counter review.
  • If a drain will cross the slab to an island, who confirms the slab is not post-tensioned before it is cut?
  • For a gas range, who installs the excess flow device and, if the line is altered, the seismic or excess flow valve after the meter?
  • Check the B or B-2 license at cslb.ca.gov; a B-2 cannot alter load-bearing walls or take on electrical, plumbing or mechanical systems without that license or a subcontractor who holds it.
  • Who removes the debris: Milpitas Sanitation's boxes, or you in your own vehicle?

Questions

Milpitas kitchen remodel questions, from the slab to the creek

We are only replacing the cabinets and counters in our Milpitas kitchen. Is that a permit job?

Not the boxes and tops themselves: the city lists cabinets, counter tops and similar finish work among projects that need no building permit. Milpitas is strict about what comes with them, though. Installing or repairing a light, switch or receptacle takes an electrical permit, and replacing a defective trap or drain under the sink counts as new plumbing work that needs a permit.

Our house is near Berryessa Creek. Can a kitchen remodel set off the flood-zone rules?

It can, if the house is inside the Special Flood Hazard Area. Milpitas counts an improvement costing 49 percent or more of the structure's value before work as a substantial improvement and adds up improvements over 10 years. The city asks for a recent appraisal and a signed declaration, uses the higher of its valuation data or the contractor's estimate, and then applies the rules for new buildings.

Can our remodeler haul the old Milpitas kitchen away in his own truck?

The city's construction debris page allows two routes: Milpitas Sanitation, the franchise hauler, or self-hauling by the property's owner, occupant or resident in their own vehicle. Self-haulers must keep organic waste such as untreated wood and cardboard apart from other debris. A kitchen remodel that adds no conditioned space does not need the CALGreen recycling report.

We are moving the range closer to the hallway. Does that affect our smoke alarm?

It can. Milpitas's alarm certificate keeps a smoke alarm at least 20 feet from a permanently installed cooking appliance, or 10 feet for a photoelectric alarm or an ionization alarm with a silencing switch. In an open plan where 10 feet would rule out every required spot, a photoelectric alarm may go more than 6 feet away. Alarms must be in place before the final.

Will an induction range change how we permit a heat pump later in Milpitas?

It can. The city's online permit types for a heat pump water heater or a heat pump HVAC system replacing gas equipment are offered only when no electric cooktop or range and no EV charger is already installed in the home. Once the kitchen has induction, those later projects go through the regular permit submittal instead of the online form.
