City of Milpitas rules that decide the scope

  1. Who maintains which part of the side sewer

    The city's code defines the house lateral as the part of the side sewer in the public street and the house sewer as the part on private property. Since a January 2021 amendment, the user owns the entire house sewer, clears and repairs it, and must have a cleanout at the property line between the two. The city's Sewer page still quotes older wording, including city repair at no charge of a structurally failed house lateral, so ask Public Works before a street section is dug up.

  2. Automatic gas shut-off devices

    Citing MMC II-170-2.00, the Office of Building Safety requires an excess flow device at the appliance outlet when any gas appliance is replaced or installed, and a seismic or excess flow device after the PG&E service tee whenever the gas line is altered or extended. Seismic valves mount rigidly to the outside of the building. Both kinds must be listed, carry a 30-year warranty, be installed by a contractor in the right license class, and have a permit.

  3. Plumbing permits that can be issued online

    The city's list of online permit types covers single-family houses and duplexes, not multifamily or commercial buildings, and allows one item per permit. For plumbing it includes the underfloor building drain up to 2 feet outside the house, the exterior sewer lateral and cleanouts with pipe bursting allowed, water piping inside the house, the main water line outside it, and water heaters. Anything not on the list goes in by emailed application or plan submittal.

  4. Six pressure zones in the water master plan

    The city's water master plan describes six pressure zones, four fed by SFPUC and two by Valley Water. The SFPUC area covers the valley floor and the hillsides, while Valley Water serves only the valley floor. Zones SF3 and SF4 in the hills are filled by pump stations, and the upper part of SF4, fed from the Minnis Tank, has static service pressure of 74 to 170 psi. The Valley Water zone VW2 runs 108 to 131.

A city sewer since the 1950s that runs downhill to the Bay

Milpitas has operated its own sewer collection system since the 1950s, and almost all of its houses were built after that. The system flows from east to west and south to north, toward the Bay. Most of it reaches the Milpitas Main Pump Station by gravity, and from there twin force mains push it to the San Jose-Santa Clara Regional Wastewater Facility. One small corner is the exception: part of the Pines neighborhood sits too low to drain by gravity, and the Venus Way Lift Station raises its sewage first. Water runs the other way. Pump stations lift it from the valley floor to hillside tanks, and the elevation difference back down is why some streets see pressures well above the 80 psi at which the city requires a regulator.

Which side of the freeways your water comes from

  • The eastern hillsides

    Only SFPUC water reaches the hills, mostly Hetch Hetchy snowmelt averaging 60 ppm of hardness in 2025. It is pumped up through the Country Club and Tularcitos pump stations to hillside tanks, and the lower streets in the highest zone are fed through pressure reducing valves because of the elevation drop.

  • West of I-880, and south of Calaveras west of I-680

    This side gets Valley Water, treated at the Penitencia and Santa Teresa plants from mostly Delta water. It averaged 100.5 ppm of hardness in 2025, moderately hard on the city's scale, so it is the side where a softener question for a new water heater is worth asking.

The work

Where a Milpitas plumbing call usually ends up

  1. Taming pressure that is too high

    The city's residential water heater handout requires a pressure regulator, preceded by a strainer and placed after the building shut-off, wherever pressure is above 80 psi, and it has to stay accessible so the strainer can be cleaned. Once a regulator is in, an expansion tank sized for the heater is required too. The water quality report gives the city-wide range as 40 to 140 psi and suggests checking strainers and regulators when pressure drops suddenly.

  2. A backup in the house sewer

    Under the code as amended in January 2021, the owner owns the entire house sewer, the pipe on private property, and is responsible for maintaining, repairing and replacing it and clearing every stoppage in it. The owner also has to keep it free of roots and grease and keep a capped cleanout at the property line, where the house sewer meets the house lateral under the street.

  3. Replacing the house sewer

    The city's sewer line handout covers the run from 2 feet outside the building to the back of the city sidewalk. At the underground inspection the new pipe is plugged and filled with water to the top of the building cleanout, and a camera has to be on site when the inspector arrives to check for dips and burrs. Cured-in-place liners may not be used on collapsed or compromised pipe, and an old line left in the ground is capped within 5 feet of the property line.

  4. Swapping a gas water heater

    A same-type heater in the same spot can go through the online permit called ONL WATERHEATER. Milpitas adds a requirement of its own: an approved excess flow gas shut-off device goes in at the appliance outlet whenever a gas appliance is replaced or added. Switching that heater to a heat pump model can also be filed online, as long as no panel upgrade is needed and the house has no EV charger or electric range already.

  5. New water piping, inside or out

    Replacing the pipe inside the house and replacing the service line from the meter are separate online permits. The city's water service handout asks for a full-way valve on the house side of the meter that stays accessible at all times, PEX sleeved wherever it is laid in soil, and yard piping at least 12 inches below finished grade. The city's own service line inventory found no lead or galvanized lines needing replacement.

Before you hire

  • Ask the plumber to measure the static pressure at a hose bib before quoting a water heater, and whether a regulator is required.
  • Is there a capped cleanout at the property line? The code requires one, and it is the access point where your pipe meets the street section.
  • For a gas water heater, confirm the excess flow shut-off device is in the scope and on the permit.
  • Ask which online permit type the job goes under, or why it needs a full application instead.

You are. Since the code was amended in January 2021, the user owns the entire house sewer, the section on private property, and is responsible for clearing, maintaining, repairing and replacing it. The code also requires a capped cleanout at the property line. For the section under the street, the house lateral, check with Public Works before any digging.

Why does the water pressure in our hillside Milpitas house seem so high?

The city's water heater rules require a pressure regulator with a strainer wherever pressure exceeds 80 psi, which a plumber can confirm with a gauge.

Is Milpitas water hard enough to need a softener?

That depends on your address. Valley Water supply, serving the area west of I-880 and the part south of Calaveras Boulevard west of I-680, averaged 100.5 ppm in 2025. SFPUC water, serving the rest, averaged 60. The city keeps the two apart under normal conditions, so check the water supply map in its annual water quality report first.

Does our Milpitas house have a lead service line?

The city's initial service line inventory, sent to the state's Division of Drinking Water on October 16, 2024, found no lead or galvanized service lines, public or private, that need replacing. Pipe and fixtures inside the house are another matter, and the water quality report suggests flushing the pipes for several minutes before using tap water for drinking or cooking.

Why did the inspector ask about our fireplace chimney during a plumbing final?

Milpitas requires smoke alarms, carbon monoxide alarms and spark arresters on chimneys serving solid-fuel fireplaces before it finals a residential permit, a sewer line or water heater permit included. If the inspector cannot check them in person, the owner can sign the city's certificate of compliance and hand it over at the final inspection.

What is the valve the city wants on our new gas water heater?

An excess flow gas shut-off device, which detects a sudden surge in gas flow, such as when a pipe breaks, and shuts it off. Milpitas requires one at the appliance outlet whenever a gas appliance is replaced. If the gas line itself is altered, a seismic or excess flow valve is also required downstream of the meter.
