Home remodeling Oakland

What a kitchen remodel sets off at Oakland's permit counter

A kitchen remodel in Oakland needs a building permit even when every wall stays put, and the application is reviewed by the Bureau of Planning before the Building Bureau sees it. What the outside of the house does decides the rest: a like-for-like refit can claim a Design Review Exemption, an enlarged window goes to Small Project Design Review, and scraped paint in a pre-1978 kitchen brings a Lead-Based Paint Permit of its own.

The houses here

Trios of small rooms, hex tile counters and plaster

Rehab Right, the manual Oakland's planning department wrote for owners of old houses, describes the kitchen a Victorian here started as: a trio of small rooms, one for cooking, one for washing, one for storage. The Craftsman bungalows that followed folded those functions into a single room arranged around a work triangle, so a bungalow kitchen usually needs less rearranging than a Victorian one of the same size. The manual also names a detail worth keeping, the small white hexagonal tiles found in Oakland houses from about 1910 to 1930, used on kitchen floors and on kitchen counters of the same period, which it says should be repeated in kind rather than swapped for modern squares. Walls and ceilings in all of them are plaster.

The work

The four scopes Oakland sorts kitchen applications into

  1. A refit that keeps every wall and window where it is

This is the narrowest route through the city: no wall layout change, no window work, no plan check, applied for online by the owner or the contractor. Two city pages have to be read together before anyone assumes it needs nothing at all. The list of work exempt from a building permit includes cabinets, countertops, tiling and similar finish work, with painting exempt except where it disturbs paint on a pre-1978 structure; the bathroom and kitchen remodel page states that a building permit is required for any kitchen remodel. The Permit Center settles which side a given scope lands on. In a house or duplex, the electrical, plumbing and mechanical work rides on that one building permit instead of separate trade permits.

  2. Removing the wall between the kitchen and the pantry

Rehab Right used this exact job as its example of improving a floor plan: a Victorian kitchen of three small rooms converted into one large room with a work triangle and space for the family to gather. Its instructions have not aged. Never take a wall out before its structural role is settled; have an architect or builder evaluate the load and how it will be transferred; and salvage the molding, wainscotting, doorframes and caps off the wall before it is demolished, since they are the right material for patching elsewhere in the house. Once plans are involved, the application lands in the Engineer of the Day queue rather than at the counter.

  3. A wider window over the sink

Glass swapped inside the original frame opening, matching what was there, stays inside the Design Review Exemption. Widening the opening or cutting a new one does not: it becomes a Small Project Design Review, and the submittal asks for photographs of the whole facade where the windows change, floor and site plans, and structural calculations where they apply. Either way the energy paperwork follows the glass. For a residential building of three stories or below, Oakland takes its own CF1R Energy Form for Fenestration or another approved energy form; four stories and above use the full Title 24 envelope compliance form.

  4. A soft floor at the sink, found on demolition day

Oakland's own manual flags where rot shows up in these houses: subfloor damage from excessive water, primarily in the kitchen near the sink, read off the finished floor as buckling, discoloration or a spongy patch underfoot. It usually turns up under linoleum laid over the original softwood or over the old hex tile, and it moves the job from cabinets to framing and flooring. Worth settling in writing before demolition how a find like that is handled, since by then the permit and the recycling plan are both open.

Permits and local rules

City requirements that decide what the job becomes

  1. Every kitchen remodel starts at the Bureau of Planning

The city's bathroom and kitchen remodel page is plain about two things: a building permit is required, and the application begins with review by the Bureau of Planning. It then splits applications four ways, by whether the job changes window or wall layout and, if it does, whether that change is exempt from Design Review or needs Small Project Design Review. Applicants are either a contractor whose state license class suits the work and who holds a current Business Tax Certificate, or the building's owner or their legal representative. Only projects outside houses and duplexes need separate mechanical, electrical and plumbing permits alongside the building permit.

  2. Design Review Exemption, and the step above it

Planning Code Section 17.136.025 lists the project types that skip Design Review, and like-for-like kitchen and bathroom remodels are on it, next to like-for-like window replacement where the frame openings do not change. The conditions matter: new outside work has to match how the building already looks or looked, and it must not affect the structure's character-defining elements. Small additions ride along at 10 percent or less of the floor area or footprint on the site, or up to 250 square feet where the existing floor area or footprint is under 2,500. Exemptions are final and cannot be appealed. A scope past those limits goes to Small Project Design Review under Section 17.136.030, which planning staff may approve administratively.

  3. The Lead-Based Paint Permit Oakland asks for separately

Work that disturbs paint on a building put up before 1978 takes its own Lead-Based Paint Permit, with a Lead Hazards Work Plan uploaded at application. The plan sets out how the lead will be removed or controlled, how dust and chips will be contained, how the material will be disposed of, who is doing the work and, where tenants are involved, how they will be moved. Only workers holding California Department of Public Health or EPA certification may carry out lead hazard control here. An inspection comes before work starts, and a Work Completion Self-Certification goes to the inspector at the final. The city stops work on a project that disturbs paint without the permit and plan.

  4. No recycling plan, no permit

Oakland will not issue a building permit until a recycling plan, the WRRP, is approved in Green Halo, and will not schedule the final until a summary report follows it. The targets apply to every permit regardless of size: all inert material, concrete and soil and stone among it, recovered in full, and 65 percent of everything else. Who may carry the load away is limited too. An Oakland-authorized hauler can; so can the contractor who did the work, using their own employees and fixed-body vehicles; so can the property owner. A company hired only for demolition may not haul construction debris from any Oakland jobsite.

Part by part

Where the street-facing side of the job changes the review

  • Old Oakland and Oak Center

Nine districts sit on the city's list of preservation districts in the S-7 and S-20 zones, Victorian Row in Old Oakland and the Oak Center district between Brush and Union streets among them. Inside them, exterior changes are design-reviewed by the Landmarks Preservation Advisory Board and its staff, so a kitchen that keeps its windows is a much shorter application than one cutting a new opening on the street side.

  • Clawson, Bella Vista and Jingletown

The city's rating system gives these as examples of district status 2, an Area of Secondary Importance. A house rated minor on its own can still be a Potential Designated Historic Property because it contributes to such a district, and PDHPs are about a fifth of Oakland's buildings. Significant exterior change to one is subject to review and postponement, with staff wanting to talk through its character-defining elements first.

  • The hill neighborhoods

Construction inside the boundaries of the Wildfire Prevention Benefit Assessment District has to follow fire-safe practices: extinguishing equipment on site, no open flames, no smoking on Red Flag days, and care with power tools and mechanical equipment. A kitchen job brings saws and heat to the house, so ask how the crew handles that and where materials will sit on a narrow street.

Timing

The permit side, by the city's own averages

Oakland publishes average processing times and says they are general guidance rather than exact. A kitchen or bath remodel with no wall change, no window or exterior work and no plan check is listed at three days up to two weeks. Add window work, still with no wall change, and the planning approval it needs puts it at three days up to four weeks. A kitchen that needs plans goes into the Engineer of the Day queue at around ten days, and a residential alteration or addition under regular review at twenty-one. Those are business days, and an application stays valid 180 days from the file date unless an extension is filed.

Before you hire

Questions worth asking before the Oakland cabinets come out

  • Which of the city's four kitchen application routes does this scope take, and does any window or wall change send it to Planning first?
  • If the house went up before 1978 and paint will be disturbed, ask who writes the Lead Hazards Work Plan and who holds the CDPH or EPA certification.
  • Ask who opens the Green Halo recycling plan, who files the summary report before the final, and which Oakland-authorized hauler or facility takes the old cabinets.
  • Ask which parts a B-2 would subcontract: it may make only minor alterations to existing plumbing and wiring, and no structural change to a bearing wall.
  • Before any wall comes out, ask who evaluates its structural role and whether their drawings come with the bid.

Questions

Kitchen remodel questions Oakland owners bring to the counter

We only want new cabinets and counters. Does Oakland call that a permit job?

Ask the Permit Center, because two city pages point different ways. Cabinets, countertops, tiling, carpeting and papering sit on Oakland's list of work exempt from a building permit, and painting is on it too, except where it disturbs paint on a pre-1978 structure. The bathroom and kitchen remodel page, meanwhile, says a building permit is required for any kitchen remodel. Once plumbing, wiring or paint on an old wall is touched, the question answers itself.

Why does an interior kitchen remodel here start with the Bureau of Planning?

Because the city routes these applications that way: its bathroom and kitchen remodel page says the application begins with review by the Bureau of Planning. Planning is looking for anything that changes the outside, which is also what decides whether the job is exempt from Design Review, needs Small Project Design Review, or is purely a building matter. A kitchen that keeps its wall layout and its windows clears that step quickly.

Paint will be scraped in our 1915 kitchen. What does the city want first?

A Lead-Based Paint Permit, with a Lead Hazards Work Plan uploaded at application, since the house predates 1978. The plan covers containment of dust and chips, disposal, who performs the work, and relocating tenants if there are any. Lead hazard control itself is limited to workers holding California Department of Public Health or EPA certification. Small amounts sit outside the rule, under six square feet in one room indoors or twenty outdoors, but the city says window work always takes the safety steps.

Are there hours when a crew may not work on an Oakland house?

Oakland's construction noise table shows no restriction on hours for work under a building permit, which surprises people, but it caps the sound instead: in a residential area, 70 decibels as a five-minute maximum level in any hour between 7 a.m. and 9 p.m. Construction noise from 9 p.m. to 7 a.m. is handled as a persistent-noise nuisance. Grading is the exception with set hours, and none at all on Sundays and holidays.

Our block is an Area of Secondary Importance. Does that reach a kitchen?

Only where the work shows outside. Contributing to such a district can make a house a Potential Designated Historic Property even with a minor individual rating, and significant exterior change to a PDHP is subject to review and postponement, with staff discussing its character-defining elements. Interior work that leaves the windows and walls alone is not part of that conversation. The city's zoning map reports a property's historic significance by address.
