Lateral certificates, cast iron drains and hill water pressure in Oakland

Selling or heavily remodeling an Oakland house usually puts a plumber on the sewer lateral first. Oakland is one of the cities in EBMUD's regional lateral program, so the pipe out to the main has to pass an EBMUD inspection before a compliance certificate is issued, and the city requires its own Sewer Lateral permit, with an inspector who checks pipe material, connections and compaction tests. Inside pre-war houses, the usual finding is galvanized supply pipe and cast iron drains.

Certificates and permits on an Oakland plumbing job

  1. EBMUD Regional Private Sewer Lateral Ordinance

    EBMUD requires a lateral to be shown leak-free when a property is bought or sold, when building or remodeling crosses its valuation threshold, or when the water meter size changes. The sequence is: check the property's status in EBMUD's search tool, hire a contractor to test and repair, obtain any municipal permits, schedule the EBMUD inspection, and receive the certificate. Owners can also certify voluntarily, and an enforcement decision can be appealed within 30 calendar days.

  2. Oakland's Sewer Lateral permit

    Oakland's Department of Transportation issues a Sewer Lateral permit for lateral installation on private property or in the city right-of-way, and the city requires one for the EBMUD lateral inspection. A contractor whose license class covers lateral work applies online, by email or at the counter on the second floor of 250 Frank H. Ogawa Plaza. Inspections must be requested 48 hours ahead, and the inspector checks pipe material and connections and asks for compaction test results. A creek nearby can add a Creek Protection Permit.

  3. When Oakland requires a plumbing permit

    Oakland's Planning & Building Department requires a plumbing permit for pipes, drains, and water and gas systems. Its exemptions are narrow: fixing leaks in drain or vent pipes, unclogging pipes or toilets, and fixing a leaking valve or fixture as long as no new parts are installed. Permits go to a contractor with the right license class and a current Business Tax Certificate, or to the owner, and work with no plan check is issued as soon as the application is paid.

  4. EBMUD's service line inventory

    EBMUD publishes a searchable inventory of the material on both sides of each service line, the district side it owns and the customer side the property owner is responsible for. The district reports no lead service lines in its system. Customer-side galvanized iron lines that were once connected to district lead lines are listed as galvanized requiring replacement, or GRR, so an owner can look up the address before a plumber quotes the line from the meter.

What the city's rehab manual found under Oakland floors

Oakland's 1978 owner's manual for old houses, Rehab Right, describes the plumbing most pre-war houses here still start from: galvanized steel water supply and cast iron drain-waste-vent pipe. It warns that galvanized lines grow fragile with corrosion and frozen fittings, and that houses built before the war were fed through a narrower service pipe than the size that became standard in 1949. Quoting a city inspector, it reported that the drain connection to the street sewer was broken in practically one of every four old houses in Oakland, and listed the signs: rodent burrows, broken curbs, and one bright green tree in a brown lawn.

Where an Oakland plumbing call tends to lead

  1. Testing and fixing a lateral before escrow closes

    Three events trigger EBMUD's lateral rule in Oakland: buying or selling the property, building or remodeling past the ordinance's valuation threshold, and changing the size of the water meter. A plumber runs a camera down the lateral, repairs or replaces it under the city's Sewer Lateral permit, and then schedules EBMUD's inspection. The certificate is issued once the lateral is shown to be leak-free. For a sale it is what lets escrow close; for a remodel it is needed before final sign-off on the building permit.

  2. Repiping galvanized supply in plaster houses

    In a 1910s or 1920s Oakland house the supply lines are usually galvanized steel, rusted inside until two fixtures can no longer run at once without the flow dropping. Replacing them runs new pipe from the main shutoff to each fixture, through lath-and-plaster walls and the crawlspace. Oakland requires a plumbing permit for work on pipes, drains, and water and gas systems, so the new piping is inspected before the walls are closed. Cast iron drains found along the way may be sound or may be next on the list.

  3. The customer side of the EBMUD service line

    EBMUD owns the service line on its side of the meter; the pipe from the meter to the house is the owner's. The district says it has no lead service lines today, since the lead lines installed from 1943 to 1945 were replaced with copper or plastic. Some customer-side lines are galvanized iron that was once connected to one of those lead lines, and EBMUD's inventory marks them GRR, galvanized requiring replacement. That pipe is a plumber's job to replace.

  4. Pressure problems on hill streets

    EBMUD serves the East Bay from sea level to roughly 1,500 feet through 122 pressure zones, with about 100 pressure regulators or rate control stations in its own system. Two Oakland houses a few blocks apart can therefore see very different street pressure, and a hill house near the bottom of its zone can run high. A plumber should gauge the pressure at the house before recommending a regulating valve, and check the water heater's expansion setup if one goes in.

  5. Laterals under condos and HOAs

    EBMUD gave homeowner associations until July 12, 2021 to certify the laterals they maintain, and an HOA that had not complied was told to return a Statement of Responsibility form. When an Oakland condo sells, that statement decides who acts: if the HOA maintains every lateral, the owner does nothing, but an owner responsible for any part needs a compliance certificate or a time extension. Buyers should ask for the form and confirm EBMUD received it.

  • Look the address up in EBMUD's service line inventory and ask whether the customer side is listed as galvanized requiring replacement.

  • If a creek, ravine or culvert lies near the lateral route, ask whether the city's creek determination has been done.

What Oakland owners ask before the pipes come out

Escrow closes before our lateral can be fixed. Can the sale still go through?

Yes, if a Time Extension Certificate is in place. EBMUD issues one when title transfers before the lateral has its compliance certificate, and it allows 180 days from issue for the work to be finished. It is requested through EBMUD's property search tool, with a fee and a refundable deposit, and it applies only to title transfers, not to remodels.

Who inspects a new sewer lateral in Oakland, the city or EBMUD?

Both, for different reasons. Oakland's inspector, under the city's Sewer Lateral permit, looks at the pipe material and connections and asks for compaction test results from the trench. EBMUD's inspection is the one that verifies the lateral is leak-free and leads to the compliance certificate. The contractor usually schedules each, and the city needs 48 hours' notice.

Does EBMUD still have lead pipes on Oakland streets?

EBMUD says it has no lead service lines now. The lead lines it installed between 1943 and 1945 were replaced with copper or plastic, and there are no customer-side lead lines either. What remains are some customer-side galvanized lines that were once attached to lead, which its inventory lists as galvanized requiring replacement.

Our Oakland condo is for sale. Does our unit need its own lateral certificate?

It depends on who maintains the laterals. EBMUD required HOAs to certify the laterals under their maintenance by July 12, 2021. If the HOA maintains them all, the seller does nothing; if the owner maintains all or part, the owner needs a certificate or a time extension. Get the HOA's Statement of Responsibility into the title company's file.

Can a dripping valve in an Oakland house be fixed without a permit?

Usually, yes. Oakland exempts fixing a leak in a valve or fixture as long as no new parts are installed, along with clearing clogs and fixing leaks in drain or vent pipes. Once pipe is replaced, rerouted or added, including any gas line, the city expects a plumbing permit and an inspection before the work is covered.
