Working in Atherton: what the town asks of a handyman

Atherton's business license code lists handymen as a category of their own, taxes them on gross receipts earned in town up to a small cap, and starts the license year on July 1. Contractors may not build, deliver or pick up on Saturdays, Sundays or town holidays, and weekday work runs 8 a.m. to 5 p.m. Gates, street-side fences and decks more than six inches above grade each need a permit.

Atherton's business license categories and the handyman class

Atherton Municipal Code chapter 5.12 sorts businesses into four categories, and Category IV names handymen outright, alongside horseshoers, solicitors and delivery vehicles; the town's application page describes it as sole operators with no employees. Sole-operator subcontractors fall in Category III, and firms of two or more in Category I or II. Each category pays five percent of the gross receipts earned in the town or a fixed amount, whichever is lower, with an administrative fee built in. Taxes are due July 1 and delinquent after 5 p.m. on July 31. Applications are on the town website or at Town Hall, 80 Fair Oaks Lane, payment is by cash or check only, and section 15.04.020 bars a building permit for any contractor without a town business license.

Permits

Permits Atherton requires for fences, gates and site work

  • Fences, gates and columns

Atherton requires a building permit for any fence within 10 feet of a right-of-way, generally capped at 6 feet, while an interior fence between neighbors that stays more than 10 feet from the street needs neither Planning review nor a permit. Gates, gate posts and columns count as accessory structures and always need a permit: 10 feet maximum including light fixtures, a 16-foot clear opening for vehicle gates, and no swing over the public right-of-way. Within the 30-foot triangle at a corner, nothing may exceed 3 feet.

  • Separate permits and the gate-to-street strip

Each structure in Atherton gets its own building permit, including decks more than six inches above grade and photovoltaic systems on a building, though outdoor kitchens, seat walls, fire pits and fountains can share one landscape permit. Any work in the right-of-way, generally the strip from the gate to the street, such as a driveway approach or planting, needs an encroachment permit from Public Works. New applications are uploaded through the town's ePlan submittal page, and eTRAKiT shows a parcel's permit history.

  • Parking plans and the job sign

Before plan check, an Atherton construction project needs a construction, operation and parking plan approved by the building official (section 15.40.152). The town allows one combined construction sign per property, bought from the town, and signs within 6 feet of the pavement edge can be removed without warning. Changing where vehicles park mid-project takes an alternate parking request to Code Enforcement with the affected owners' written approval, and approval can take up to three business days.

The homes

Atherton's homes in Census figures

The 2019-2023 American Community Survey counts 2,673 housing units in Atherton, and 98.0% of them are detached single-family houses, with a median of 10 rooms per home, so nearly every call is to a large detached house. The median year built is 1960: the town's history notes more than 80 subdivisions recorded in the 1940s and 1950s, and 24.5% of homes date from the 1950s, while 14.3% were built before 1940 and 12.7% from 2010 to 2019. Owners occupy 87.4% of occupied homes, so the owner is usually the client, and 76.7% heat with utility gas.

Part by part

Parts of Atherton and the rules that follow them

  • Lindenwood

The town history traces Lindenwood to James C. Flood's Linden Towers estate, subdivided in 1938. The General Plan notes that lower-lying parts of Lindenwood require finished floors raised, typically by about a foot, in new construction, with the height set by the project engineer during the town's grading and drainage review, so ask about it before quoting an addition or a new slab.

  • Regulated street frontages

Lots on El Camino Real, Marsh Road, Middlefield Road, Valparaiso Avenue, Alameda de las Pulgas, Bay Road and Ringwood Avenue may carry a fence or wall 6 feet above natural grade or 8 feet above the pavement centerline, whichever is higher, which changes how tall a replacement fence there can be.

  • Along the Caltrain line and school campuses

Lot lines next to the railroad right-of-way or a public or private school may have fences up to 8 feet instead of 6, and the General Plan places Sacred Heart Schools and Menlo School on Valparaiso Avenue. The Caltrain tracks cross town at grade only at Fair Oaks Lane and Watkins Avenue, so expect waits at those gates when moving between jobs.

Getting around

Work hours, deliveries and truck parking in Atherton

Section 15.40.120 bars construction, pickup and delivery from 5 p.m. to 8 a.m. on weekdays and all day on Saturdays, Sundays and town holidays; only residents doing their own work get a 10 a.m. to 5 p.m. weekend window. Delivery trucks may not arrive before 8 a.m., must leave by 5 p.m., and unload on site where possible with engines off. Work vehicles park on the property or in front of it on the same side of the street, and blocking a road for over five minutes is a violation. The Police Chief can exempt work that cannot stop, such as a concrete pour.

Questions

Working in Atherton: what pros ask

Which Atherton license category covers a one-person handyman business?

Category IV, which the code names for handymen, along with horseshoers, solicitors and delivery vehicles. The tax is five percent of gross receipts from work done in the town or a fixed amount, whichever is lower. It is due July 1 and delinquent after July 31, and the town takes cash or check only, not cards.

Can I finish an Atherton job on a Saturday if the owner agrees?

No. Construction, pickup and delivery are prohibited on Saturdays, Sundays and town holidays no matter what the owner wants; the weekend exemption from 10 a.m. to 5 p.m. covers only residents doing their own work. For work that cannot be interrupted, the Police Chief can grant an exemption, and the contractor must notify neighbors at least 72 hours ahead.

Does replacing a gate or building a low deck in Atherton need a permit?

A gate does: gates, gate posts and columns are accessory structures that need a building permit, with a 10-foot height limit including lights. A deck needs its own permit once it is more than six inches above grade. An interior fence that stays more than 10 feet from the right-of-way and under 6 feet needs no permit.

Where can my truck park at an Atherton job?

On the property, or on the street directly in front of it on the same side. Parking anywhere else needs an approved alternate parking plan, which Code Enforcement reviews with written consent from the owners in front of whom you would park, and it is generally not approved on both sides of a street. Do not block the road for more than five minutes.

How do I book a building inspection in Atherton?

Request it before 2 p.m. on the business day before, with the permit number, job address, inspection type and a site contact. Inspections run from 8 a.m. to noon and roughly 1 to 4 p.m., and someone must be on site with the approved plans and job card. Cancel by 8 a.m. on the day if the work is not ready.
