Burlingame for a pro: no Sunday work, hillside notices, balcony repairs

In Burlingame, permitted building work stops completely on Sundays and holidays unless the building official approves it in writing, and weekdays start at 8 a.m. The business license tax has been tiered by gross receipts since a 2022 vote, and out-of-town firms pay it too. Hillside additions go to neighbors within 100 feet for a view review, and with 42.5 percent of homes in buildings of five or more units, many balcony and stair repairs follow the state inspection laws and need permits.

Burlingame's business license tax and who collects it

Burlingame's code requires anyone engaging in business in the city to obtain and keep a valid business license, and the Finance page says the ordinance also covers businesses that operate within city limits without a physical location there. A ballot measure passed on November 8, 2022 replaced the old flat fee with three tiers set by annual gross receipts, the top one starting at a million dollars a year. Since July 10, 2023, HdL Companies has handled every new application, renewal notice, payment and compliance question. The license is a tax for revenue only, says nothing about your state license, must be renewed each year and has to be posted. A first-time license may need sign-off from building, fire, planning and county health, and a home-based business also needs a Home Occupation Permit.

Permits

Burlingame permits: eTRAKiT types, hillside notice, balconies

  • Choosing the right eTRAKiT permit type

Every permit type is filed online through eTRAKiT, only complete submittals are processed, and each PDF is named by street name, street number and document type. Window replacements, re-roofs, kitchen and bath remodels and garage-to-ADU conversions file as Residential Alteration, with at least 15 business days of review. A panel, EV charger or rewire outside a remodel files as Residential Electrical, and a furnace or heat pump as Residential Mechanical, each reviewed in 5 to 10 business days. Water heater, water service and sewer lateral work is Residential Plumbing, with a gas line schematic showing pipe length, size and material. Single-family solar and storage go through Symbium.

  • A Hillside Area Construction Permit comes first

Inside the Hillside Overlay Zone of Code Section 25.20.040, any new house, new accessory structure or addition, including a change in roof elevation, needs a Hillside Area Construction Permit before the building permit. Plans go to every property owner within 100 feet for a 10-day review, and any of them can call the project up to a Planning Commission hearing. With no call-up it is approved and stays valid for two years. The point is to protect existing distant views from inside nearby homes, and fences that meet code are exempt.

  • Balcony and stair repairs after a state inspection

The city's page on SB 721 and SB 326 applies the state inspections to wood- or steel-framed balconies, decks, stairways, landings and guardrails more than six feet above grade on buildings with three or more units. When an inspection finds problems, the owner applies for a permit within 120 days and finishes the work within 120 days of approval. Ordinary maintenance repairs need no permit, but cutting, notching or replacing framing, replacing membranes, waterproofing or exterior finishes, and guardrail replacement all do.

The homes

13,675 homes, three in ten from before 1940

The ACS 2019-2023 estimates put Burlingame's housing at 13,675 units, with a median year built of 1957, and 29.9 percent of them were built in 1939 or earlier. The 1940s, 1950s and 1960s add another 38.6 percent, so 80.3 percent were standing before 1980. Detached houses make up only 48.7 percent of units, while buildings of five or more units hold 42.5 percent, every one of them big enough to fall under the state balcony inspection laws. Owners occupy 50.5 percent of occupied homes, and utility gas heats 63.1 percent of them.

Part by part

Burlingame districts and the work they bring

  • The hillside tracts

The General Plan describes the hillsides as tracts of 1960s ranch houses with a sprinkling of Eichlers, where owners have already invested heavily and city staff expect strong pressure to remodel and expand. Those projects meet both the Hillside Area Construction Permit and Planning Commission design review, which covers every new house and most second-story additions.

  • North Burlingame and Broadway

Ranch and Eichler homes from the 1940s to the 1960s are particularly common in the post-war neighborhoods that followed the subdivision of the Mills Estate at the north end. The Broadway commercial district works as their neighborhood shopping street, and a business approved on Broadway joins the Broadway Business Improvement District automatically.

  • Permit-parking blocks near the commercial districts

Residential permit parking covers all of Douglas Avenue, the 1200 to 1400 blocks of Bellevue Avenue, the 1500 and 1600 blocks of Howard and Chapin avenues and the 200 to 400 blocks of Occidental Avenue, among others. During restricted hours only residents with city permits and their visitors may park there for long, so a work truck needs another spot.

  • Rollins Road

An industrial corridor dating from the middle of the last century: light manufacturing, warehousing, auto repair and wholesale, with tennis and indoor soccer added in the early 2000s. The road is four lanes with parking on both sides that delivery trucks use at certain hours. In the Rollins Road Mixed Use zone weekday work may start at 7 a.m., but chainsaws, jackhammers and impact wrenches wait until 8.

  • Burlingame Hills

Burlingame Hills sits in the city's sphere of influence but is unincorporated: large-lot single-family homes and natural hillside open space. Construction there is permitted and inspected by San Mateo County's Building Section, not by Burlingame, and its sewers belong to the county-governed Burlingame Hills Sewer Maintenance District.

Getting around

A Burlingame workday: 8 to 7, quiet Sundays, right-of-way limits

Burlingame allows building work from 8 a.m. to 7 p.m. on weekdays and 9 a.m. to 6 p.m. on Saturdays, and none on Sundays or the ten holidays the code lists without the building official's written approval. The limits do not reach work that needs no permit, or fully enclosed interior work kept below the outdoor ambient noise level. Work in the public right-of-way runs only 8 a.m. to 5 p.m. on weekdays that are not city holidays, and sandblasting keeps to 8 to 5, Monday through Friday. Highway 101 is the dividing line between the Bayfront, with its hotels for SFO travelers and its industry, and the rest of the city.

Questions

Working in Burlingame: what pros ask

Do I owe Burlingame's business license tax if my shop is in San Bruno?

Yes. The city says its ordinance requires businesses that operate within Burlingame but have no physical location there to pay the tax. Applications and renewals go through HdL Companies, and the amount depends on which of the three gross-receipts tiers adopted by voters in November 2022 you fall in. The Building Division lists business license renewals among the items that must be cleared before a permit is issued.

Can I work on a Burlingame homeowner's project on a Sunday?

Not on permitted work. The code bars erecting, altering or repairing a structure on Sundays and holidays unless the building official approves it in writing, which is reserved for things like large concrete pours or public health and safety. Work that needs no permit falls outside the rule, and so does quiet interior work in a fully enclosed building kept below the outdoor ambient noise level.

What does a hillside homeowner in Burlingame need before a second story?

Usually two approvals before the building permit. Most second-story additions go to the Planning Commission for design review, and inside the Hillside Overlay Zone any addition or change in roof elevation also needs a Hillside Area Construction Permit, which gives owners within 100 feet ten days to call it up to a hearing. The city publishes a map of the properties in the overlay.

Who issues permits for a job in Burlingame Hills?

San Mateo County. Burlingame Hills is unincorporated land in Burlingame's sphere of influence, so construction there is reviewed and inspected by the county's Building Section, which handles permitted work in all unincorporated areas. Sewer service comes from the Burlingame Hills Sewer Maintenance District, governed by the county Board of Supervisors.

What does a hot-list text for a Burlingame job tell me?

The kind of work, the area and a link, sent as the job goes on sale, between 8 a.m. and 8 p.m. The texts cover new jobs across the whole Bay Area, not only Burlingame. Opening the link shows the job and what it costs, and nothing is charged until you decide to buy it. There is no monthly fee, no bidding against other pros and no commission on the work, and replying STOP ends the texts.
