What Oakland asks before you sand, reroof or park a dumpster

Oakland bills an annual business tax to every independent contractor working in the city, wherever the shop is, and renewals fall due each March 1. Any job that disturbs paint on a building from before 1978 needs a lead-based paint permit, and 77.9 percent of the city's housing units were built before 1980. Re-roofs run on a certificate the owner or contractor completes after the work, and hill job sites in the 1991 fire area keep fire-safe rules.

Working legally here

Oakland's business tax certificate and its March 1 deadline

Oakland's Business Tax Office says anyone conducting business in the city files and pays an annual business tax, and its list names self-employed persons and independent contractors outright. A business located outside Oakland that works inside it still has to pay for the Business Tax Certificate. A non-refundable registration fee, with state and city surcharges, is due within 30 days of your start date, together with a pre-payment of tax on estimated gross receipts through December 31 that is trued up at the next renewal. Renewals are due on or before March 1; a late one adds a 10 percent penalty within 30 days and 35 percent after that, plus 1 percent interest a month. An Oakland-based shop needs a zoning clearance first. With an email address on file, the certificate arrives in 2 to 3 business days.

Permits

Oakland permits: lead paint, digital permits, re-roofs, trees

  • A lead-based paint permit for pre-1978 buildings

Oakland requires a Lead-Based Paint Permit for work that disturbs paint on any building built before 1978: sanding, scraping, removing paint and pressure washing, painting-only jobs included. You apply in the Online Permit Center and upload a Lead Hazards Work Plan showing how dust and chips are contained and the waste disposed of. Minor work is exempt, under 6 square feet of disturbed paint per room inside or 20 square feet outside, but window work never qualifies. The city says it will stop a job that disturbs paint without the permit, and only workers holding California Department of Public Health or EPA certification may remove or control lead hazards.

  • Digital MEP permits and the re-roofing certificate

Oakland's digital permits are applied for online and issue automatically once the fees are paid. They cover mechanical, electrical and plumbing permits, solar systems and painting a pre-1978 home, but not sewer lateral work, foundation repair, seismic retrofits or remodels that open structural walls. A re-roof goes on a Re-Roofing Certificate instead: you describe the work, finish it to code, then fill out Section 2 and upload it to the record, one structure per certificate and 180 days of validity. Only owners, or contractors with the right state license classification and a current Oakland Business Tax Certificate, can be issued one.

  • Tree removal and street-facing fences

The Public Works tree page says Oakland's Protected Trees Ordinance, OMC 12.36, requires a permit for the removal of any tree on public or private property, either tied to a design review, building, grading or demolition permit or as a stand-alone application. Protected trees that stay on a work site are fenced off at a distance the Tree Reviewer sets, with no ropes or wires tied to them and no grade change near them. Separately, a wood or metal fence up to 7 feet needs no building permit, though one over 42 inches facing a street may need planning approval.

The homes

187,847 homes, most of them built before 1980

The ACS 2019-2023 estimates count 187,847 housing units in Oakland, with a median year built of 1953. Units from 1939 or earlier are 36.7 percent, and the 1940s, 1950s, 1960s and 1970s each added roughly another tenth, so 67.7 percent of the stock was already built by 1969. So on most painting, trim and window jobs that disturb old paint, the lead-permit rule for pre-1978 buildings applies. Detached houses make up 41.6 percent of units, while buildings of 20 or more units hold 22.2 percent. Owners occupy 41.7 percent of occupied homes. Utility gas heats 62.9 percent of them and electricity 30.2 percent.

Part by part

Oakland districts and what they change about a job

  • Oak Center, West Oakland

The 1965 Oak Center urban renewal plan covered a 56-block residential area beside downtown, mostly Victorian buildings; many were rehabilitated, others were demolished and their lots later built on. The Oak Center Historic District, an S-20 zone since 2003, runs along Brush and Union streets from 10th to 18th and 20th streets, and the city says most exterior changes to a building need some level of design review.

  • Adams Point and the Bellevue-Staten district

The Bellevue-Staten Apartment District, an S-7 preservation zone since 1997, takes in parts of Bellevue, Elita and Staten avenues next to Lakeside Park. These are apartment buildings, not houses, so jobs are arranged with an owner or property manager, and exterior work on designated buildings goes through Oakland's historic design review.

  • The hills fire area

About 26,000 parcels lie in the Wildland-Urban Interface Fire Area of the Oakland Hills, where the 1991 Tunnel Fire destroyed 3,469 houses and apartments. In June 2025 the council stretched the Very High Fire Hazard Severity Zone over that whole area. Job sites inside the Wildfire Prevention Benefit Assessment District keep a fire extinguisher or a connected hose ready, use no open flame, and ban smoking on Red Flag days.

Getting around

An Oakland workday: sound limits, street permits, permit zones

Oakland sets no hourly window for building permits, but in residential areas construction between 7 a.m. and 9 p.m. may reach 70 dB for no more than five minutes in any hour, night construction noise from 9 p.m. to 7 a.m. is a nuisance, and domestic power tools are barred from 9 p.m. to 6 a.m. Trucks and dumpsters park on one side of the street so a lane stays open, and blocking parking, a curb, sidewalk or lane takes an Obstruction Permit with No Parking signs posted 72 hours ahead. Residential permit streets are marked with two colored lines. Every site needs a toilet, and grading may not run on Sundays or holidays.

Questions

Working in Oakland: what pros ask

Do I need an Oakland business tax certificate if my shop is in Hayward?

Yes. The Business Tax Office says a business located outside Oakland that does business in the city has to pay for the certificate, and its list of who pays names independent contractors and self-employed persons. Register within 30 days of starting work there, prepay tax on your estimated gross receipts to December 31, and renew by March 1. The city's online license search shows whether an account is current.

Do I need a permit just to repaint an older Oakland house?

If the building dates from before 1978 and the job disturbs paint, yes: sanding, scraping or pressure washing brings in the Lead-Based Paint Permit even when painting is the whole job. Painting over old paint without sanding or scraping does not. Disturbing under 6 square feet per room inside or 20 outside is exempt, except on windows, and so is an owner-occupant doing his own work with unpaid help.

Can I take out a small tree in an Oakland backyard as part of a job?

Plan on a permit. The city's Tree Services page says the Protected Trees Ordinance requires one to remove any tree on public or private property. A removal that is part of a project needing design review or a zoning, building, grading or demolition permit goes through the development-related tree permit; any other removal uses the non-development permit. Ask Tree Services about your specific tree before quoting the work.

Where can a dumpster go on an Oakland street?

In the street only with an Obstruction Permit, which covers blocking parking, a curb or gutter, a sidewalk or a traffic lane. The city issues No Parking signs with it, and they must be up 72 hours before the obstruction, with at least 5 feet 6 inches of sidewalk left clear. A commercial street, a lane closure or a work area over 300 feet also needs a Traffic Control Plan.

Does joining the hot list tie me to Oakland jobs?

No. Each new job arrives as a text with the type of work, the area and a link, sent between 8 a.m. and 8 p.m. for jobs anywhere in the Bay Area. The link opens the job with its price before you pay, you are charged only for the ones you take, and there is no monthly fee and no bidding. Reply STOP and the texts end.
