Working in Berkeley: gross-receipts tax, BESO credits and creek setbacks

Berkeley taxes contractors on gross receipts and approves no building permit while a contractor's business license has lapsed. Since January 2026, anyone selling a house or duplex must finish six credits of energy upgrades or pass them to the buyer, who then has two years. Every plumbing or mechanical permit brings a gas shut-off valve with it, renters fill 56.7 percent of occupied homes, and power tools may run on Sundays.

Berkeley's business tax on a contractor's gross receipts

Berkeley Municipal Code 9.04 requires a current business tax certificate from every business operating in the city, and the Finance Department names contractors applying for building permits on that list. Construction contractors file under their own class, taxed on gross receipts at a dollar eighty per thousand dollars, with a minimum charge. A new application is a paper form, mailed or brought to the Customer Service Center at 1947 Center Street with a check. A business with a Berkeley address also needs a Zoning Certificate, or a Home Occupation permit if you work from home. Certificates expire December 31 and must be renewed before March 1; a 10 percent penalty lands on March 1 and another 40 percent on April 1. Contractors may renew online, and no building permit is approved while the license is inactive.

Permits

Berkeley permits: hidden triggers, BESO credits, rental checks

  • What a permit brings with it, and what needs none

Applications go through Permits Online, and a minor permit needs no plans. Berkeley's own amendment, BMC 19.34.040, adds a gas shut-off valve whenever an addition, alteration or repair is done under a mechanical or plumbing permit, so a water heater or furnace job carries one. Smoke detectors come with any project valued at a thousand dollars or more, and a Private Sewer Lateral Certificate with one valued at sixty thousand or more. Painting, tiling, cabinets, countertops and a fence under 7 feet need no building permit, though a fence over 6 feet needs a zoning permit.

  • BESO credits when a house or duplex sells

From January 1, 2026, the seller of a Berkeley single-family home or duplex must get a Home Energy Score and then either complete upgrades worth six credits before the sale or defer them to the buyer, who has two years and may ask for one more. Credits come from a fixed menu: a heat pump water heater or an electrical panel upgrade earns 6, window replacements 2 or 4, attic insulation 2, duct sealing 2, crawlspace insulation 1 and air sealing 1. The work must be permitted, with "for BESO compliance" written in the scope of work.

  • Rental checks that end in repair lists

Owners of Berkeley rentals must self-inspect every unit by July 1 each year under the Rental Housing Safety Program, and the City also inspects randomly chosen properties for working smoke and carbon monoxide alarms, egress from bedrooms and GFCI outlets where required. Buildings with three or more units and a wood or steel deck, balcony or stair more than six feet up fall under the Exterior Elevated Elements program: non-emergency repairs found in that inspection need a permit applied for within 120 days, and the work finished within 120 days of approval.

The homes

Berkeley's 52,112 homes, nearly half built before 1940

The 2019-2023 American Community Survey counts 52,112 housing units in Berkeley with a median year built of 1946, and 45.2 percent of them went up in 1939 or earlier. Detached houses make up 40.4 percent of units. Buildings of two to four units hold another 18.0 percent and buildings of 20 or more units 19.1 percent. Renters occupy 56.7 percent of occupied homes, so a large share of the work happens in rented units. Utility gas heats 67.7 percent of occupied homes and electricity 26.8 percent, and a heat pump water heater on its own meets the six-credit BESO target.

Part by part

Berkeley districts and the work each one sends out

  • Southside, below campus

The Southside Plan area runs from Bancroft Way to Dwight Way between Fulton and Prospect streets, about 28 blocks, and the plan counts 5,350 dwelling units there with renters in 96 percent of them. By the late 1960s some houses had given way to student apartments and others were split into several rentals, and 2023 zoning changes allow larger, denser buildings. Unit turnovers, yearly safety checklists and stair or balcony repairs are the usual calls.

  • Codornices Creek blocks

Most of Berkeley's creeks run in culverts under the flatlands, and the General Plan names Codornices Creek as the one that stays open there; the block between Eighth and Ninth streets was reopened. Under the Creeks Ordinance, new buildings and expansions of buildings, decks, pavement and bridges within 30 feet of an open creek's centerline are regulated, so check the city's creek map layer before pricing a deck or patio near it.

  • Along the Strawberry Creek culvert

Strawberry Creek runs underground from the campus edge at Oxford Street, under Civic Center Park and across McKinley, Grant, Roosevelt and McGee, toward Curtis and Addison streets; a 200-foot stretch was opened in Strawberry Creek Park. Building within 25 feet of a culverted creek means verifying where it runs, and regulated construction within 15 feet needs a Culverted Creek Permit from Public Works.

  • The hills in Fire Zone 2

Fire Zone 2 covers the Combined Hillside District and the areas CAL FIRE maps as Very High hazard. The Building and Safety guideline for it requires a Class A roof and bans wood shakes and shingles whatever the assembly rating, unless less than half the roof is replaced within five years. A reroof there also brings a spark arrestor on any solid-fuel chimney and gutters fitted to keep leaves out.

Getting around

Hours, parking and the counter at 1947 Center Street

Berkeley allows construction noise from 7 a.m. to 7 p.m. on weekdays and 9 a.m. to 8 p.m. on weekends and holidays, the same window it sets for saws, sanders and garden tools, and gas-powered leaf blowers are illegal anywhere in the city. On Residential Preferential Parking blocks the two-hour limit is generally enforced from 8 a.m. to 7 p.m. on weekdays; residents can buy one-day or 14-day visitor permits, and every vehicle is still held to the 72-hour rule. The Permit Service Center, with the zoning counter, is on the third floor of 1947 Center Street, by appointment.

Questions

Working in Berkeley: what pros ask

Does an Oakland-based contractor need a Berkeley business license for one job?

Yes. BMC 9.04 covers every business operating in Berkeley directly or indirectly, and contractors applying for building permits are named on the Finance Department's list. The tax is figured on gross receipts under the construction contractor class, with a minimum. The Zoning Certificate step applies to businesses with a Berkeley address, but every contractor's license must be active before a building permit is approved.

Which Berkeley jobs can I take without a building permit?

The city's exemption list includes painting, papering, tiling, carpeting, cabinets and countertops; removing and resetting a toilet when no valves, pipes or fixtures change; clearing stoppages and stopping leaks; and fences under 7 feet. Replacing a concealed trap, drain or supply pipe does need a permit. A zoning permit can still apply when a building permit does not, for example a fence over 6 feet.

What comes with a water heater permit in Berkeley?

A plumbing permit triggers Berkeley's gas shut-off valve amendment in BMC 19.34.040, so plan that valve into the job, along with carbon monoxide detectors, and smoke detectors once the project is valued at a thousand dollars or more. If the client chooses a heat pump water heater, it earns all six credits a Berkeley house or duplex needs under BESO when it is sold.

Can I run a saw on a Sunday in Berkeley?

Yes, within limits. The city allows construction noise and powered tools from 9 a.m. to 8 p.m. on weekends and holidays and from 7 a.m. to 7 p.m. on weekdays, with maximum sound levels by zone. Gas-powered leaf blowers are illegal at any hour, so bring an electric one or a rake to a yard cleanup.

A client bought a Berkeley house and the BESO upgrades were deferred. What can I do for them?

The buyer has two years from the sale to reach six credits, and can request one more year. Smaller items add up: window replacements count 2 or 4, attic insulation 2, duct sealing 2, a whole-house fan 2, crawlspace insulation 1 and air sealing 1. Each needs a permit naming BESO compliance, and an early deposit refund requires a signed contract with a licensed contractor.

I mostly work in Oakland. Will Berkeley jobs reach me on the hot list?

Yes. The hot list texts every new Bay Area job as it goes on sale, whatever the trade or city, between 8 a.m. and 8 p.m., so handyman leads in Berkeley arrive alongside the rest. Each text gives the trade, the area and a link that shows the job and its price before you pay. You pay only for jobs you pick, with no subscription or bidding, and STOP ends the texts.
