Working in Benicia: a per-worker tax, self-issuing permits, quiet Sundays

Benicia's license tax adds a charge for each person you pay to a tax on last year's receipts, and a 1099 helper without a Benicia certificate of his own counts in that head count. The bill falls due every February 1. Maintenance-type permits issue themselves online, while plan-reviewed ones run on posted clocks. Within 500 feet of homes, outside work stops at 7 p.m. and does not run on Sundays.

Working legally here

Benicia's license tax: counted per worker and per dollar, due February 1

Chapter 5.04 makes everyone engaging in business in Benicia pay a license tax, whether or not they keep a fixed place there, and the city's page adds that home-based businesses are included; applications and renewals are filed online through HdL. Chapter 5.06 builds the bill from two parts: a personnel tax for each person you employ or pay, counting 1099 workers who held no valid Benicia certificate, and a gross receipts tax on the prior calendar year with a floor and a cap. The personnel rate and the cap are indexed each year to Bay Area inflation. The tax is due February 1 and delinquent April 1. A general contractor may leave out payments to subcontractors holding their own Benicia license by reporting their names, addresses and amounts.

Permits

Benicia permits: express records, posted clocks, Air District notices

  • Express and SolarAPP+ permits issue themselves

The Benicia Permit Center on OpenGov takes applications, reviews, issues and schedules inspections. Express permits, which take the place of traditional over-the-counter permits, are self-issuing for maintenance-type work that needs no plan review, and SolarAPP+ does the same for qualifying solar. The city warns that pulling an express permit for work that really needs plan check adds cost and delay, and makes contractors and owners responsible for staying inside the express limits. New applications have been checked against the 2025 California codes since January 1, 2026.

  • Plan review clocks and expiry dates

For permits that need plan review, the posted targets are 7 to 10 working days for intake, about 18 working days of review for a typical project and up to 5 working days to issue. An application left incomplete for 30 calendar days is rejected, a submittal after 3 p.m. starts the next working day, and City Hall closes on alternating Fridays. After issue, a stand-alone mechanical or plumbing permit has 180 days to reach final inspection; other building permits have 365.

  • Tell the Air District before a fireplace comes out

Benicia's renovation and demolition page explains that the Bay Area Air District must be notified at least 10 business days before any structural demolition, whatever the asbestos content, and before removing 100 square feet or more of material that is over 1 percent asbestos. Its examples include removing or dismantling a fireplace, taking out an in-ground pool and some roofing work. A residential building of four or fewer units may notify 72 hours ahead for an added fee.

The homes

11,454 homes, six in ten from the 1970s and 1980s

The ACS 2019-2023 estimates count 11,454 housing units in Benicia, with a median year built of 1981. The 1980s alone account for 35.2 percent of units and the 1970s for 24.7 percent, so six homes in ten were built in those twenty years, while only 7.1 percent predate 1940. Detached houses make up 64.3 percent, attached townhouses 10.2 percent and mobile homes 4.5 percent; buildings of 20 or more units hold 6.1 percent. Owners occupy 71.2 percent of occupied homes, and utility gas heats 67.9 percent of them.

Part by part

Benicia areas, from wartime tracts to the Industrial Park

  • Linda Vista, between East Second and East Third

Herbert Mayson Co. finished 110 homes here in 1941 for Arsenal workers, the city's historic context statement says, when defense housing on federally backed loans was exempt from the wartime halt on private building. They predate the hillside subdivisions by two decades, so expect more than eighty years of owner changes behind the walls.

  • The Highlands and West Manor

The Highlands put 290 houses on 60 hilly acres in 1942, on streets that curve with the grade, loop into circles and end in cul-de-sacs, named La Cruz or Corte Dorado instead of numbers and letters. West Manor added 123 more in 1943 around Buena Vista, a long circle entered past pylons on Alta Loma.

  • Southampton

Jack Rooklyn announced plans in 1964 to develop more than 7,000 acres as Southampton. The historic context notes that the hills above downtown filled with houses on streets following the topography, built with integral garages that take up a large share of their floor area, so the garage is often a big part of the house.

  • Benicia Industrial Park

The park opened in February 1964 on former Arsenal land under a 66-year lease, and the Army's warehouses, workshops and production buildings were leased to private employers, while a refinery went up on 400 acres in the northern part of the old grounds. Much of the commercial work here is in buildings designed for military use.

Getting around

A Benicia workday: two interstates, set hours, closed Fridays

I-680 comes across the strait from Martinez and cuts through the old Arsenal grounds toward Cordelia, while I-780, the former route of the interstate, runs west to Vallejo. Section 8.20.150 bars outside construction or repair work, and heavy equipment, in a downtown mixed use district or within 500 feet of a residential zone before 7 a.m. or after 7 p.m. on weekdays, before 8 a.m. or after 7 p.m. on Saturdays, and all day Sunday, unless the city manager grants a permit; emergency work needs none. City offices close on alternating Fridays, so plan permit errands around them.

Questions

Working in Benicia: what pros ask

Does a 1099 helper raise my Benicia license tax?

Usually. The personnel tax counts W-2 employees and anyone you pay on a 1099 who did not hold a valid Benicia business license certificate during that time. Someone who worked fewer than 2,000 hours for you in the prior calendar year counts as a fraction, the hours worked divided by 2,000, so a part-time helper adds only part of the per-person charge.

When is my first Benicia license tax due if I start in the middle of the year?

File an initial statement within 30 days of starting work in the city. No tax falls due until the first February 1 that comes more than 31 days after your first day there, and where Chapter 5.06 sets a minimum gross receipts tax, that minimum is prorated by the whole or partial months left in the calendar year when you started.

Do I need a Benicia tab on my van?

The code says a taxpayer who uses a motor vehicle in the business fixes a city-issued tab to it, in the manner the administrator sets, showing the license tax is paid. The administrator may waive the tab for a business running three or more vehicles in the city, or wherever it is not needed to administer the tax.

Do I have to name my subcontractors to Benicia?

Yes. The annual statement each taxpayer files must list every contractor or subcontractor it engaged to do business in the city during the preceding year. The same names, addresses and amounts let a general contractor leave payments to subcontractors who hold their own Benicia license out of its gross receipts, and records backing the return are kept for at least four years.

How do handyman leads in Benicia compare with the rest of the hot list?

They come the same way as every other job. The list is not split by county or trade: a text goes out for each new Bay Area job between 8 a.m. and 8 p.m., naming the trade and area with a link that shows the job and its price before you pay. You pay only for the ones you pick, with no subscription, no bidding and no commission, and STOP ends it.
