Hayward for pros: Measure CC, reroof limits and rental inspections

Hayward still taxes businesses under a license ordinance set on July 11, 1978, and Measure CC on the November 2026 ballot would move it toward gross receipts. Reroofing more than 200 square feet takes a permit, and a house roof may not be white or reflective. Every water heater swap needs a plumbing permit. Rental units fall under a mandatory inspection program dating from 1989, whose usual findings, from smoke alarms to faulty plumbing, become repair work.

Hayward's 1978 business license tax, and Measure CC

Hayward requires a business license from every person, firm or company conducting business in the city, with one application form for businesses inside city limits, home-based ones included, and another for those outside. Forms are emailed or faxed in; once approved, the Revenue Division contacts you with the amount and payment instructions, and renewals run online through the city's HdL portal. The out-of-town form asks a contractor holding a state license under Business and Professions Code 7033 for the classification, license number, employees on the Hayward jobsite and the job's start and end dates. Today the tax follows a flat rate by category, employee count or gross receipts. Measure CC, on the November 3, 2026 ballot, would shift it to a gross-receipts structure with lower rates for lower-grossing businesses.

Permits

Hayward permits: water heaters, reroofs and the exempt list

  • Every water heater needs a plumbing permit

Hayward requires a plumbing permit, pulled before work starts, to install, remove, replace or relocate a water heater. Its checklist wants earthquake straps across the upper and lower thirds of the tank, a gas shutoff within 6 feet, a sediment trap, a relief-valve drain ending outside 6 to 24 inches above grade, and an expansion tank wherever a check valve, backflow preventer or pressure regulator is present. A single-family tank of 55 gallons or less uses the city's CF-1R-ALT energy form, and electric resistance units need special measures, unlike heat pump models.

  • Reroofs: 200 square feet, one overlay, no white

A building permit is required once more than 200 square feet of roof covering is installed, repaired or replaced. A new roof may go over only one existing layer, and never over wood shake, slate, clay or cement tile, or a water-soaked base. Residential roofs may not be white or reflective, and a single-family reroof needs no cool roof in Hayward's climate zone. The inspector comes for a pre-roof check once the old covering is off, needs a secured ladder rated for 250 pounds reaching 3 feet above the roof, and looks for chimney spark arrestors before final.

  • No permit needed, and the next-day rule

Hayward's exemption list for one- and two-family homes covers countertops and cabinets replaced in the same layout, plus paint, carpet, flooring and tile, but tile inside a tub or shower enclosure needs a permit. Fences of 7 feet or less need Planning approval instead of a building permit. Fixing plumbing leaks, replacing small sections of non-structural dry rot and running low-voltage wiring need nothing. When equipment or a gas leak has to be handled as an emergency, the permit must be obtained by the next working day.

The homes

Hayward's 52,182 homes, from tracts to mobile home parks

The 2019-2023 American Community Survey puts Hayward at 52,182 housing units with a median year built of 1972. The 1950s built 25.7 percent of today's stock, the 1970s 17.6 percent and the 1980s 12.8 percent. Detached houses are 51.7 percent of units and attached houses 10.8 percent, 18.0 percent sit in buildings of 20 or more units, and mobile homes make up 4.5 percent. Owners occupy 56.9 percent of occupied homes. In the city's Housing Element, Code Enforcement estimates that about 10 percent of occupied units are substandard, most of them suitable for rehabilitation, with moisture damage, faulty wiring, plumbing, windows, roofs and siding among the common violations.

Hayward neighborhoods named in the city's housing plans

  • Mt. Eden and Southgate

The Housing Plan lists Mt. Eden and Southgate among the neighborhoods with concentrations of older single-family houses and lower incomes, where the City aims outreach for its Minor Home Repair Program. Its grants fund health and safety fixes, code corrections, exterior repairs and accessibility changes for lower-income owners, including elderly and disabled ones.

  • Santa Clara and Harder-Tennyson

Both are on the same outreach list for older housing, and Santa Clara is also one of Hayward's eight Residential Parking Permit zones, with Eden Gardens, Ocie Way, Modoc Avenue, Parkside Drive, South Hayward BART, Happyland Avenue and Westpark Street. In a permit zone, settle where your truck will park before the job starts.

  • Eden Shores and Woodland Estates

Each has a homeowners association that met with the City during the General Plan update. In association tracts, Hayward's reroof handout says to confirm materials and colors against the design guidelines, and a tree removal or pruning permit needs an HOA approval letter on top of review by the City's Landscape Architect, usually about a week.

  • The ten mobile home parks

The Housing Element counts 2,268 mobile home spaces in 10 parks, with space rents under a stabilization ordinance. Housing Plan policy H-1.2 covers rehabilitation of owner-occupied mobile homes as well as conventional houses for lower-income households, so the parks are part of the City's repair picture.

Getting around

Freeways, construction hours and the 777 B Street counter

Interstate 880, State Routes 92, 238 and 185, and two BART lines run through Hayward, across terrain that climbs from the bay flats to steep eastern hillsides. Construction may run 7 a.m. to 7 p.m. Monday through Saturday and 10 a.m. to 6 p.m. on Sundays and holidays under Municipal Code Chapter 4, and the Police Department handles complaints. The Permit Center in the first-floor lobby at 777 B Street takes walk-ins Monday to Thursday from 9 to 1 and appointments from 1 to 5; Fridays are virtual only. The e-Permits portal lets an owner add you to a project and shows the inspector's estimated arrival.

Questions

Working in Hayward: what pros ask

Do I need a Hayward business license if my shop is in Fremont?

Yes. Every business conducting business in Hayward needs one, and out-of-town firms use their own application form, emailed or faxed to the Revenue Division. A licensed contractor lists the classification, license number, number of employees on the Hayward jobsite and the job dates. A home-based business can shield its home address with a separate service-of-process address under AB 2184.

What would Measure CC change for a small contractor in Hayward?

The current tax took effect July 11, 1978, and its structure and rates have not been amended in 48 years. Measure CC, on the November 3, 2026 ballot, would move to a more progressive gross-receipts structure, with higher rates for higher-grossing businesses and lower rates for lower-grossing ones. Nothing changes unless voters approve it.

Can I use PEX on a Hayward repipe?

Yes. The Building Division says plastic pipe is now allowed in Hayward, with ABS, PVC, PEX and similar materials approved for use. The city enforces the 2025 California codes with only minor local amendments to the mechanical and electrical codes, and a repipe still needs its building permit, since nearly all plumbing work does.

Can I roof over the old shingles on a Hayward house?

Only if there is a single existing layer in sound condition. Two existing layers both come off, and no overlay may go over wood shake, slate, clay or cement tile, or a water-soaked base. Above 200 square feet a permit is required, the first inspection happens after tear-off or preparation, and white or reflective colors are not permitted on homes.

What does a Hayward rental inspection usually flag?

The Residential Rental Inspection Program, in place since 1989, lists unpermitted construction or installations, missing or dead smoke detectors, faulty mechanical appliances, faulty weather protection, faulty plumbing, junk and debris, mold and mildew, and general deferred maintenance as its most common violations. Owners who qualify for self-certification, approved in 2014, can opt out of inspections but still pay the annual fees.

How do Hayward jobs reach me on the hot list?

By text, one for each new Bay Area job as it goes on sale, whatever the trade or city, between 8 a.m. and 8 p.m. Each names the trade and area and links to the job, where you see the details and the price before paying anything. You pay only for the handyman leads in Hayward or elsewhere that you pick; there is no subscription and no bidding, and STOP ends the texts.
