Hayward and state rules a garage door job runs into

  1. Hayward's permit exemptions, and their limits

    Hayward's Do I Need a Permit? handout opens by saying building permits are required for almost all construction-related work, structural and electrical included, and that the only exceptions are the ones it lists. Its list for one- and two-family houses covers small sheds, play structures, fences, cabinets, finishes, low retaining walls and awnings; garage doors are not on it. Emergency equipment replacement may go ahead, provided a building permit is obtained by the next working day.

  2. Mandatory soft-story screening

    Adopted on July 2, 2019, Hayward's ordinance created a soft-story registry and requires screening of buildings built or permitted before January 1, 1979 that have three or more dwelling units and two or more stories. Screening forms were due by October 30, 2020 for parcels with five or more units and by April 30, 2021 for smaller ones. Retrofitting is voluntary, with criteria in HMC Chapter 9 Article 7, created by Ordinance 19-14.

  3. Removing an unpermitted garage conversion

    The city's handout on unpermitted structures and additions lists the steps for removing a garage conversion: a site plan that need not be drawn by a professional, a floor plan of the garage area only, showing what will be removed and the garage's interior dimensions, then a demolition permit issued to the owner or a licensed contractor. A BAAQMD J-number is required for demolishing structures or additions, but not for removing an interior garage conversion.

  4. California's battery backup law

    Health and Safety Code Section 19892 has, since July 1, 2019, barred manufacturing for sale, selling or installing a residential automatic garage door opener in California without a battery backup that keeps it working without interruption during a power outage. It also bars connecting a replacement residential garage door to an existing opener that lacks the backup, regardless of the opener's date of manufacture.

Garages that did not always stay garages

Some Hayward garages have since become bedrooms or family rooms, and the city's handout on unpermitted construction gives garage conversions their own removal steps. Apartment buildings went a different way: the city says multifamily buildings with tuck-under parking stalls on the ground floor usually have the weak, open lower level that defines a soft-story building. On both kinds of property, the garage opening is where the door work and the city's paperwork meet.

  1. Turning a converted room back into a garage

    Hayward offers two ways out of an unpermitted conversion: legalize it to current codes with an experienced designer, or remove it. To remove it, the owner prepares a legible site plan and a floor plan of the garage area showing what comes out and the interior dimensions, and the city issues a demolition permit to the owner or a licensed contractor. Once the conversion is out and the opening restored, a D-28 installer fits the new door and opener.

  2. Doors in tuck-under apartment parking

    The city's soft-story ordinance requires screening, not retrofitting. A building can leave the registry if an engineering evaluation shows it does not qualify, or after a voluntary retrofit meeting HMC Section 9-7.500, under a permit described as a voluntary seismic retrofit. Those retrofits strengthen the open ground story, which is where the garage openings are, so doors, tracks and openers are best scheduled after the new framing rather than before.

  3. Retiring the door when the garage becomes an ADU

    Hayward's ADU checklist requires an attached unit to have its own exterior entrance, allows no internal connection to the main house, and calls for a one-hour fire-rated wall running from the bottom of the footing to the underside of the roof deck. When the converted garage sits under living space, the floor-ceiling between them needs the same rating. The plans also have to show what fills the old garage door opening, since the unit needs its own entrance and the fire separation has to stay continuous.

  4. Replacing a door under the battery backup law

    Swapping only the door is limited by state law: since July 1, 2019, a replacement residential garage door may not be connected to an existing opener without a battery backup, whatever the opener's age. On an older Hayward house, the installer should check that the existing opener has the backup and still reverses on a two-inch obstacle before quoting the door alone; if it fails either, the opener is replaced too.

No. Hayward's ADU checklist requires a separate exterior entrance and does not allow an internal connection to the main house, because the two must be divided by a one-hour fire-rated wall from footing to roof deck. If the unit sits under living space, the floor-ceiling between them needs the same rating. Your plans should also show what replaces the garage door in its opening.
