Berkeley plumbing under the city's own sewer lateral law

The plumbing job that holds up a Berkeley house sale is the sewer lateral, and the rules are the city's own rather than EBMUD's regional ordinance. A Sewer Lateral Certificate is needed before escrow closes and before a permit for a large remodel, and unless the lateral was replaced in the last twenty years, it earns one by passing a water or air test a city inspector watches. A second local rule rides on every plumbing or mechanical permit: a motion-activated gas shutoff valve.

Berkeley's testing guidelines say outright that an owner who knows the lateral is old clay pipe, or already has defects, may skip the test and go straight to replacement. The city looks after the lower lateral, from the main in the street to a cleanout at or near the curb; everything upstream of that cleanout is the owner's. Some lots drain instead to a city main running through an easement behind the house, and there the owner's share runs all the way to and including the connection to that main. A certificate is issued for the whole parcel, so a lot with a backyard cottage or a second building needs every sewer on it checked, not only the one serving the front house.

The work

  1. The witnessed verification test

    The contractor pulls a PSL permit, sets up the test and is present while a city inspector watches and calls pass or fail on site. In a water test the standpipe holds five feet of head above the highest point of the lateral, with no visible drop over five minutes. An air test starts at about four psi and may lose no more than one psi in five minutes, and it is not allowed on rigid plastic pipe.

  2. Replacing an old lateral

    A full replacement earns the longest certificate the city issues, twenty years. Work inside the public right-of-way needs an Engineering Permit and a plumbing or sanitation sewer contractor or a general engineering contractor. On a one- or two-family lot, the private side can be done by a C-36, C-42 or B contractor, or by the owner under the state's owner-builder rules. Every contractor who pulls the permit also needs a Berkeley business license.

  3. Unhooking downspouts and yard drains

    When the city finds a roof drain, downspout or yard drain tied into the sanitary lateral, often through its smoke testing, it orders the connection corrected. The PSL permit lets the contractor alter that storm drain piping as part of getting the lateral to comply. Residents get two weeks' notice before smoke testing, and pouring water into rarely used drains keeps the smoke out of the house.

  4. A water heater swap that adds a gas valve

    Replace a gas water heater or a furnace in Berkeley under permit and the job grows by one part. On a building with a single gas meter, any plumbing or mechanical permit triggers a listed motion-activated shutoff valve on the owner's side of the meter, mounted rigidly to the building. An excess-flow valve does not count, but an automatic valve already installed and kept working does.

  1. Private Sewer Lateral ordinance, BMC Chapter 17.24

    Berkeley requires a Sewer Lateral Certificate at close of escrow on most transfers, before a building permit for construction or remodeling valued above the ordinance's threshold, when the city finds a lateral may be a public nuisance, and whenever the owner repairs or replaces it. Transfers into a revocable trust and certain transfers between spouses are among the exceptions. The city amended the ordinance in 2014 to be no less stringent than EBMUD's regional one, which does not cover Berkeley.

  2. Motion-activated gas shutoff valves, BMC 19.34.040

    Berkeley's plumbing code carries a local amendment, readopted with the 2025 codes, requiring a motion-activated gas shutoff valve whenever a plumbing or mechanical permit is issued for a building with fuel gas piping, whatever the permit's value. Where units have separate meters, the valve goes on the meter serving the unit being worked on and on the common-area meter. The valve is set to trip in a moderate or strong earthquake.

  3. Underfloor pipes in the Panoramic Mitigation Area

    Berkeley's wildfire code, adopted in December 2025 as Chapter 19.49, adds a rule for buildings erected, altered or repaired on Panoramic Hill. Utilities, pipes, furnaces and water heaters in an exposed underfloor area must be enclosed with material rated for exterior one-hour fire-resistive construction, with covered openings left for service and ventilation. A plumber working under a raised house there should price the enclosure in.

Timing

Start the lateral when the listing goes up

The city advises starting as soon as a property is listed. Public Works expects about five business days to issue a certificate or a Notice of Deficiency. After a deficiency the owner has 90 days to pass, and no certificate within 120 days of applying puts the property out of compliance. If the work cannot finish before closing, a six-month extension is possible with a deposit or a signed contract with a plumbing contractor, approved by Public Works before escrow closes.

  • Will the verification test be water or air, and is the existing pipe a material that may be air-tested?
  • Will a camera be on site for the city inspector, even though Berkeley no longer accepts video alone as proof?

Does EBMUD's sewer lateral ordinance apply to my Berkeley house?

No. EBMUD's regional ordinance covers Alameda, Albany, El Cerrito, Emeryville, Kensington, Oakland, Piedmont and the Richmond Annex, and EBMUD sends Berkeley owners to the city. Berkeley runs its own program under BMC Chapter 17.24, with its own certificate, permits and inspectors, handled by Public Works Engineering through the city's online portal.

Our Berkeley lateral passed a test four years ago. Do we need another one to sell?

Probably not. A certificate issued after a clean test is good for seven years, and one issued after a full replacement for twenty. Certificates transfer to the next owner and stay valid to the printed expiration date. The exception is a lateral the city later finds to be a nuisance, for example through smoke testing, which then needs a permit and a new test.

We own a condo in a Berkeley building with one shared lateral. Who gets the certificate?

Whoever is responsible for that lateral, often the homeowners' association. It either documents a replacement within the last twenty years or schedules a verification test, with repairs first if needed. The certificate is then issued to every unit the lateral serves, which also helps the neighbors when they sell.

Why does a water heater permit in Berkeley include a new gas valve?

Because of a local amendment to the plumbing code. Any plumbing or mechanical permit on a building with gas piping triggers a listed motion-activated gas shutoff valve on the owner's side of the meter. An excess-flow valve is not accepted as a substitute, but an existing automatic shutoff valve that still works is.

Can I replace my own sewer lateral in Berkeley?

On a one- or two-family property, the owner may do the private-side work, but only under the state's owner-builder provisions. The verification test itself must be run by a licensed contractor (C-36 Plumbing or C-42) and watched by a city inspector, and any digging in the street or sidewalk is limited to qualified contractors.
